Dinga is a car marketplace platform that connects buyers and sellers of vehicles in Kenya. Our service includes:

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Conduct

You agree not to use the Service to:

  • Post false, misleading, or fraudulent information
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Upload malicious content or software

5. Vehicle Listings

5.1 Listing Accuracy

All vehicle information must be accurate and truthful. Sellers are responsible for:

  • Providing accurate vehicle details
  • Uploading genuine vehicle photographs
  • Disclosing any known defects or issues
  • Maintaining current pricing information

5.2 Prohibited Listings

The following vehicles are prohibited from being listed:

  • Stolen vehicles
  • Vehicles with outstanding liens
  • Non-roadworthy vehicles
  • Vehicles that violate Kenyan traffic laws

6. Transactions

6.1 Buyer Responsibilities

Buyers are responsible for:

  • Conducting due diligence before purchase
  • Verifying vehicle documentation
  • Arranging vehicle inspection
  • Ensuring proper transfer of ownership

6.2 Seller Responsibilities

Sellers are responsible for:

  • Providing all necessary documentation
  • Ensuring vehicle is as described
  • Facilitating proper ownership transfer
  • Resolving any post-sale issues

7. Fees and Payments

Dinga may charge fees for certain services, including but not limited to:

  • Featured listings
  • Premium account features
  • Advertising services

All fees are non-refundable unless otherwise specified.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Dinga and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Disclaimers

Disclaimer: Dinga acts as a marketplace platform only. We do not:

  • Own, sell, or guarantee any vehicles listed
  • Verify the accuracy of vehicle information
  • Handle transactions between buyers and sellers
  • Provide vehicle inspection services

11. Limitation of Liability

In no event shall Dinga, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

12. Indemnification

You agree to defend, indemnify, and hold harmless Dinga and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service.

13. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

14. Governing Law

These Terms shall be interpreted and governed by the laws of Kenya, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
